WHAT IS WORKPLACE MEDIATION?

Workplace mediation is an informal and confidential process whereby a neutral third party – the mediator, helps parties to engage in discussions openly and honestly in a respectful and safe environment, in order to resolve their disputes in a mutually acceptable way. Mediation can be effective in both union and non-union settings and at all levels of the organization.

ADVANTAGES OF WORKPLACE MEDIATION

The workplace mediation process enables parties to craft their own solutions instead of having a solution being imposed on them by an outside party such as a judge or an arbitrator. Consequently, the parties have a high degree of control over the process. Because parties are highly involved in crafting their own solutions (with the assistance of the mediator), agreements reached through the process are more durable. Most importantly, workplace mediation also helps to foster an ongoing relationship between the parties.

THE MEDIATION PROCESS

First, IWL will consult with the organization to clarify expectations and to obtain information regarding the conflict situation. The mediator will then meet with each person involved in the conflict to hear their side of the story. Finally, the mediator will bring the parties together for a mediation session (or sessions, as may be required), during which the mediator will facilitate communications between the parties to enable them to reach a mutually acceptable agreement.

Once resolution is reached, the mediator will write up the agreement and a time frame will be set for a follow-up meeting to ensure that the parties abide by the agreement. The mediator will also provide the parties with any further support that they may need.

WHEN IS WORKPLACE MEDIATION EFFECTIVE?

Most workplace issues can be resolved through the mediation process if parties are willing to work together to try and resolve their disputes. Some types of workplace issues are particularly suited to mediation. These include:

  • complaints of bullying and harassment
  • complaints of sexual harassment
  • disputes between employees
  • employee performance
  • complaints of discrimination

Mediation is also an excellent tool to resolve disputes around severance terms, when an employee is terminated.
